completely deleted the ldm-6.10.1 directory
restarted the syslog daemon
reinstalled LDM from fresh download ..

Do the "make install_setuids" command from the source code directory,
make sure rsyslog is running

Well I done and messed something up with my LDM install
I was bouncing back and forth between root and LDM,
and must have one of the times I was root restarted LDM
because I get
hupsyslog: couldn't open /var/run/syslogd.pid
when starting/restarting LDM as ldm
but if I
'sudo ldmadmin start/restart/pqactHUP'
it does the expected

ok so how do I fix this ???

(tried reinstalling but it would go past configure)
